What condo and HOA rules should a beach buyer check?

Read the exact association's current rules, budget, reserves and assessments before relying on a beach condo's advertised monthly fee. Florida DBPR describes milestone inspections for residential condo and cooperative buildings of 3 or more habitable stories, generally at 30 years and every 10 years afterward; a local authority can require the initial inspection at 25 years. Verify the building's actual obligations and records.

Build a property-specific document checklist

Request governing documents and amendments, current budget, reserve study, insurance information, pending assessment notices and applicable inspection reports. Ask the association or authorized manager about rental minimums, tenant approval, pets, parking and planned work. A broker's summary is a starting point; do not assume an older listing describes the current rules.

Separate municipal rules from association permission

An association's permission does not establish that a use is allowed by the city. For example, Neptune Beach prohibits short-term rentals in residential zoning districts and defines them as terms of less than 28 days. Check the actual municipality, zoning and association rules before relying on rental income.

Common questions

Is a structural reserve study the same as a milestone inspection?

No. The inspection addresses structural condition; the structural integrity reserve study addresses funding for specified future repairs and replacements. Obtain the applicable documents and check the current DBPR requirements for that building.

Will this guide publish my association's private records?

No. This is a public checklist using government guidance. Property and association documents should be obtained through the authorized transaction process, not republished from a private MLS or transaction file.
