These Terms of Service ("Terms") govern your access to and use of the website and platform operated by KST Group LLC ("KST Group," "we," "our," or "us") at kstrealestate.com (the "Platform"). By accessing or using the Platform you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

Your access to and use of the Platform constitutes your agreement to these Terms and our Privacy Policy, which is incorporated by reference. We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

2. Use of the Platform

The Platform is provided for personal, non-commercial informational and real estate search purposes. You agree to use the Platform only for lawful purposes and in a manner consistent with all applicable laws and regulations. You may not use the Platform to scrape, copy, redistribute, or republish listing data or any other content; to interfere with or disrupt the Platform or its servers; to attempt to gain unauthorized access to any portion of the Platform; or for any commercial purpose without our prior written consent.

3. MLS Listing Data and IDX Terms

Property listings displayed on this Platform are sourced from the Northeast Florida Association of Realtors (NEFAR) MLS through an IDX data feed. This data is provided for consumers' personal, non-commercial use. All listing information is deemed reliable but is not guaranteed and should be independently verified. Listings are subject to prior sale, change, or withdrawal without notice. The listing broker's offer of cooperation is made only to participants of the MLS where the listing is filed. Information last updated at the time of display; contact KST Group for current availability.

4. Home Valuation Estimates

Automated home valuation estimates provided through the Platform are generated using comparable sales data and statistical modeling. They are estimates only and do not constitute a professional appraisal, a broker price opinion, or a guarantee of value. Actual market value may differ materially. KST Group makes no representation or warranty regarding the accuracy of valuation estimates. You should consult a licensed real estate professional or certified appraiser for a professional opinion of value.

5. No Agency Relationship

Use of the Platform does not create an agency, brokerage, fiduciary, or any other professional relationship between you and KST Group or any KST Group advisor. No advisor-client or attorney-client relationship is formed by submitting a form, requesting information, or communicating through the Platform. An agency relationship is only established through a separate, signed written agreement.

6. User Accounts

Certain features of the Platform require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

All content on the Platform — including text, graphics, logos, photographs, data compilations, and software — is the property of KST Group LLC or its licensors and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Platform without our prior written consent. MLS listing content is the property of the respective MLS and listing brokers and is used under license.

8. Prohibited Conduct

You agree not to: use any automated means (bots, scrapers, crawlers) to access or collect data from the Platform; reverse engineer or attempt to extract the source code of the Platform; transmit any unsolicited commercial communications through the Platform; post or transmit any false, misleading, defamatory, or unlawful content; or use the Platform in any manner that could damage, disable, or impair the Platform or interfere with other users.

9. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, DATA, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. KST GROUP DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. LISTING DATA, MARKET STATISTICS, AND VALUATION ESTIMATES ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT REFLECT CURRENT CONDITIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KST GROUP LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, ADVISORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Duval County, Florida, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We reserve the right to modify these Terms at any time by posting the revised Terms on this page with an updated effective date. Your continued use of the Platform after any modification constitutes acceptance of the revised Terms. If we make material changes we will make reasonable efforts to notify you, such as by posting a notice on the Platform.
